This End User License Agreement ("Agreement") is a legal agreement between you ("you", "your") and the developer of VisaSafe ("VisaSafe", "we", "us", "our"), an individual developer. It governs your use of the VisaSafe mobile application software, related content, and related documentation made available through Apple's App Store.
This Agreement applies between you and us, not between you and Apple, except to the extent Apple requires certain terms to apply. Your use of the App is also subject to Apple's applicable terms, including Apple's media services terms, App Store rules, and any mandatory licensed application terms imposed by Apple.
If a conflict exists between this Agreement and any mandatory Apple term required for App Store distribution, the mandatory Apple term controls to the extent required.
By downloading, installing, accessing, or using VisaSafe, you agree to this Agreement. If you do not agree, do not use the App and delete it from your devices.
You represent that you are legally permitted to use the App under the laws of your jurisdiction and that you meet the minimum age and consent requirements applicable to you. If you use the App on behalf of an organization, you represent that you have authority to bind that organization to this Agreement.
Subject to this Agreement and Apple's rules, we grant you a personal, limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the App on Apple-branded devices that you own or control, solely for your own lawful personal use, as permitted by Apple's usage rules.
No ownership rights in the App are transferred to you. All rights not expressly granted are reserved by us and our licensors.
VisaSafe helps users organize deadlines, visa-related dates, guide checklists, mood check-ins, policy summaries, and weekly status reports based on information the user enters and rule-based logic implemented in the App.

You are responsible for the data and content you choose to enter into VisaSafe, including visa-related dates, tasks, notes, attachments, mood check-ins, and checklist activity.
Your use of the App is also governed by our Privacy Policy, available at: https://jchen8863988.github.io/VisaSafe/privacy-policy.html. Please review it carefully.
Certain App functions may request access to device capabilities such as notifications, camera, or photo library. You may deny these permissions, but parts of the App may not function as intended if you do.
VisaSafe may retrieve and cache publicly hosted policy-summary content and may offer links to external official or source websites. Those materials are provided for convenience and readability only.
Some features of VisaSafe may require an optional paid subscription purchased through Apple In-App Purchase. Pricing, renewal, cancellation, billing, refunds, and account management are governed by Apple and your App Store account.
VisaSafe is not a law firm, immigration consultancy, medical provider, crisis service, school official, or emergency response service. Do not rely on the App as a substitute for professional advice.
We may update the App from time to time, including to fix bugs, improve security, comply with platform requirements, revise content, change or remove features, or reflect legal or operational changes.
Some updates may be required for continued use. We are not obligated to maintain any particular feature forever.
This Agreement remains in effect until terminated by you or us. You may terminate it at any time by stopping use of the App and deleting it from your devices.
We may suspend or terminate your license if you materially breach this Agreement or use the App in a way that creates legal risk, security risk, abuse, fraud, or harm. Upon termination, the license granted to you ends immediately.
The App, including its design, layout, text selection, compiled software, and non-user-generated content, is protected by copyright, trademark, and other intellectual property laws. Except for your own content and rights expressly granted by this Agreement, all rights remain reserved by us and our licensors.
If you send us suggestions, ideas, bug reports, or feedback, you grant us a non-exclusive, worldwide, royalty-free, perpetual license to use that feedback for any lawful purpose without obligation to you, except where prohibited by law.
To the maximum extent permitted by applicable law, the App is provided "as is" and "as available", with all faults and without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, compatibility, quiet enjoyment, accuracy, availability, and non-infringement.
We do not warrant that the App will be uninterrupted, error-free, secure, complete, current, or suitable for your particular needs, or that the App will prevent missed deadlines, immigration issues, financial loss, stress, or other harm.
To the maximum extent permitted by applicable law, we will not be liable for any indirect, incidental, special, consequential, exemplary, punitive, or similar damages, including loss of profits, loss of opportunity, loss of data, loss of goodwill, device failure, academic harm, visa-related harm, business interruption, or personal stress, arising out of or related to the App, your use of the App, inability to use the App, or reliance on App content.
To the maximum extent permitted by law, our total aggregate liability for all claims relating to the App or this Agreement shall not exceed the greater of:
Some jurisdictions do not allow certain disclaimers or limitations, so some parts of this section may not apply to you. In those cases, liability is limited to the maximum extent permitted by applicable law.
To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless us from and against claims, losses, liabilities, damages, judgments, costs, and expenses (including reasonable legal fees) arising out of or related to:
This indemnity does not apply to the extent a claim results from our gross negligence, willful misconduct, or any liability that cannot be excluded under applicable law.
You may not use, export, or re-export the App except as authorized by United States law, the laws of the jurisdiction in which you obtained the App, and any other applicable laws and regulations. By using the App, you represent that you are not located in, under the control of, or a national or resident of any prohibited jurisdiction, and are not on any applicable restricted-party list.
This Agreement is governed by applicable law, without prejudice to any mandatory consumer rights or protections that apply in your place of residence. Nothing in this Agreement excludes rights that cannot lawfully be excluded.
If any part of this Agreement is found unenforceable, the remaining parts will remain in full force and effect.
This Agreement, together with the Privacy Policy and any mandatory Apple terms, forms the entire agreement between you and us regarding the App, replacing any prior understandings relating to the same subject matter.
We may update this Agreement from time to time. When we do, we will revise the "Last updated" date above. Material changes may also be reflected in-app or on the hosted legal page where practical. Continued use of the App after the effective date of an updated version constitutes acceptance where permitted by law.
