当前试用阶段提示(v2026-05-10 新增):本软件中的云端 AI 助手等智能功能当前处于试用 / 公开测试阶段,可能因第三方生成式 AI 提供方变更、配额限流、网络波动、配置切换或防滥用措施而不稳定或暂时不可用。其余非 AI 功能(家庭成员管理、本地病历整理、用药提醒、症状记录、本地 OCR 等本地优先功能)通常可独立、正常使用,不依赖云端 AI 是否可用。详见第 7 条。
本协议由您(「用户」或「您」)与 FamilyMedVault 运营者(独立开发者,下称「我们」「许可方」)订立。若您代表组织使用本软件,您声明有权使该组织受本协议约束。
除非适用法律禁止此类限制或 Apple 政策另有允许,您不得:

本软件并非医疗器械,亦不提供诊断、治疗、处方、用药调整或急诊医疗服务。任何 AI 生成内容、摘要或提示仅为信息与就诊准备辅助,可能不完整、过时或错误。紧急健康状况请拨打当地急救电话或立即前往医疗机构。
您对基于 AI 输出所作的任何决定自行承担责任。在适用法律允许的最大范围内,我们不对 AI 输出的准确性、完整性、时效性或适用于特定目的作出任何明示或默示保证。
个人信息处理规则以我们在 App Store「隐私政策」链接及官网上发布的《隐私政策》为准(当前示例 URL:https://jchen8863988.github.io/familymedvault-legal/privacy.html;若您日后变更托管地址,以 App Store 公示为准)。本协议不改变许可方在隐私法下的告知义务,亦不构成对数据处理范围的扩大授权。
本软件可能依赖 Apple、网络运营商、托管商、AWS(含 Amazon Bedrock)、Google(含 Gemini 等生成式接口)、对象存储服务商等第三方。第三方服务的可用性、费率、接口变更与安全事件由其各自条款约束;在适用法律允许范围内,我们不对第三方中断、变更或终止承担责任,亦不对您与第三方之间的争议承担责任。
在适用法律允许的最大范围内,本软件按「现状」及「可用」基础提供,我们不作任何明示或默示担保,包括但不限于对正确性、完整性、不间断可用、无错误、无病毒、适用于特定目的或非侵权的担保。某些司法辖区不允许排除默示担保,则在该辖区内以法律允许的最低限度为准。
在适用法律允许的最大范围内:
因您违反本协议、违反适用法律或侵害第三方权利而导致针对许可方提出的合理直接索赔,在适用法律允许范围内,您同意为许可方抗辩并使许可方免于承担最终经司法机关或仲裁认定且与您的过错相称的赔偿责任。本条款不视为要求您承担明显超出您过错范围或与损害无因果关系的费用。
本协议的解释应优先尊重您所在地的强制性消费者保护规则。除非强制性法律另行指定管辖,争议解决程序依适用法律确定;欧盟等地区消费者可能享有在居住国法院起诉的权利。若您是商业用户或不受强制性消费者规则保护的主体,争议解决方式与管辖可在适用法律允许范围内另行适用合同条款 —— 但不减少对您所在地不可剥夺的消费者权利的效力。
您声明您并非位于适用法律禁止接收或使用本软件的受限主体或受限地区用户。您不得违反出口管制、制裁或技术转让法律法规使用、出口或再出口本软件。
我们可能更新本协议并在官网展示更新版本及生效日期。在法律要求或变更实质减损您权利的情况下,我们将采取合理方式提示;在适用法律允许的前提下,您在更新生效后继续使用可能构成对更新版本的接受。若您不同意更新版本,请停止使用并卸载本软件。
若本协议某条款被有管辖权的机关认定为无效或不可执行,其余条款在最大可执行范围内继续有效。
在不损害您所在地不可剥夺的强制性消费者保护规则、不与 Apple App Store 强制性政策冲突的前提下,许可方(独立个人开发者)就本协议条款保留合理的最终解释说明权,以便消除歧义、填补条款空白与统一执行口径。
该解释权明确不得用于以下情形:
若您对许可方的解释存在异议,可先通过下方联系邮箱提出书面异议;许可方应在合理期间内回复。任何最终解释均不得违反本条所列禁止事项;与之相抵触的解释无效,相关条款应回归对您更有利的、依法可执行的解读。

Beta / Trial notice: The cloud AI assistant features in this app are currently in a trial / public beta phase and may be unstable or temporarily unavailable due to third-party generative-AI provider changes (e.g. AWS Amazon Bedrock, Google Gemini), quotas, network conditions, configuration switches or anti-abuse controls. All other (non-AI) local-first features — family member profiles, local medical records, on-device OCR, medication reminders, symptom tracking and trends — continue to operate independently and do not depend on cloud AI availability. See Section 7.
This End User License Agreement ("EULA") governs your use of the FamilyMedVault iOS application (including compatible iPad distribution where offered). The application is licensed, not sold, by an individual developer.
If you obtained the app from the Apple App Store, Apple is not a party to this EULA except as required by Apple policies (e.g., App Store, payments, Standard Licensed Application terms where applicable). Apple has no warranty obligation for the Licensed Application as between you and the developer. You must comply with applicable Apple terms, including App Store rules and subscription management through your Apple ID.
In‑App Purchases & subscriptions are processed by Apple. Pricing, renewal, cancellation, and refunds follow Apple's rules. Feature access may depend on StoreKit-reported entitlements and subscription-period metadata used for AI Credits alignment. Unspent Credits that could not be consumed because cloud AI was temporarily unavailable are not deemed a loss; the developer will use commercially reasonable efforts to retain or carry over such Credits, but you retain your right to seek a refund through Apple under Apple's rules.
Optional cloud AI: When enabled, limited prompts and summary context may be sent over TLS to the operator's backend. Server-side AI typically calls AWS Amazon Bedrock first; if unavailable or not configured, it may fall back to Google generative AI (e.g., Gemini) as configured. OpenAI is not used on the server in the current implementation. Routing order, models and providers may change at any time. Outputs are informational only, not medical advice. Optional BYOK keys (typically Gemini for device-side paths) are at your risk.
No availability SLA on AI: The developer makes no guarantee regarding AI availability, latency, throughput, or output consistency. Inconvenience caused by AI outages, degradation, throttling, Credit-deduction failures, or output variance does not, to the maximum extent permitted by law, give rise to refund or compensation claims under this EULA — without prejudice to your statutory consumer rights and Apple-managed refund pathways.
Optional cloud backup: You may enter HTTPS endpoints in Settings for encrypted snapshots (e.g. presigned URLs). Backup authorization typically uses your Sign in with Apple session; there is no separate in-app token entry.
The app is not a medical device. To the maximum extent permitted by law, the app is provided "as is"; our aggregate liability is limited as described in Section 14 (typically to subscription fees paid in the prior 12 months, or USD 50 if none). We do not guarantee uninterrupted or error-free operation. Privacy practices are in our Privacy Policy linked in App Store Connect.
Final interpretation (within lawful limits): The individual developer reserves a reasonable right of final interpretation of this EULA only to resolve ambiguity or fill gaps, and not to (a) unilaterally expand the developer's rights or reduce your non-waivable consumer rights, (b) exclude liability for personal injury, fraud, gross negligence or anything else not lawfully excludable, (c) circumvent Apple Media Services / Standard EULA / App Store rules, or (d) impair your refund / dispute pathways with Apple. Any interpretation conflicting with these limits is void; the related clause shall be read in the manner most favorable to you that remains lawfully enforceable.
